These Terms & Conditions (Terms) govern your access to and use of AllCommercial.com.au and all associated services, tools, and features operated by AllMedia Group Pty Ltd (ABN 94 687 455 321). By accessing the platform, creating an account, or publishing a listing, you agree to be bound by these Terms.
These Terms apply to both individuals and the businesses or organisations they represent. Any reference to “you” and “your” includes both the individual user and the associated entity. References to “we,” “us,” and “our” refer to AllCommercial.com.au and AllMedia Group Pty Ltd, unless otherwise stated.
For the purposes of these Terms, the following definitions apply:

If you do not agree to these Terms, you must not access or use the platform.
3.1 You have the legal authority to enter into and be bound by these Terms, including on behalf of any business or organisation you represent.
3.2 Any listings, content, or materials submitted by you do not infringe the intellectual property rights or other legal rights of any third party.
3.3 You will not introduce malicious code, viruses, malware, or any other harmful components into our systems or those of any users of our Services.
3.4 You will maintain appropriate security measures to safeguard your systems and any personal or confidential data from misuse, unauthorised access, loss, or interference.
3.5 You will comply with all relevant Australian laws and regulations, including those governing commercial real estate advertising, business opportunity advertising, consumer rights, anti-discrimination, and data protection.
3.6 You must not upload, post, transmit, store, or distribute any content that is unlawful, threatening, abusive, defamatory, obscene, discriminatory, invasive of privacy, or otherwise inappropriate as reasonably determined by us.
3.7 Unless expressly authorised, you may not copy, reproduce, adapt, republish, modify, or distribute any part of our website or content, including software and underlying code.
3.8 You are responsible for ensuring you have the appropriate hardware, software, and systems required to access and use the Site effectively.
3.9 If you appoint a third party to access the platform or submit content on your behalf, you are responsible for their conduct. Any breach of these Terms by them will be treated as a breach by you.
3.10 You are not permitted to assign or transfer any rights or obligations under these Terms without our prior written consent. Any change in control of your business will be treated as an assignment requiring our prior written consent.
3.11 You agree to indemnify us (including our directors, staff, and agents) against any losses, costs, claims, or damages arising as a direct result of your fraud or deliberate misconduct, any negligent act or omission by you, or any breach of applicable laws by you.
3.12 You must not use data scraping tools, harvesting technologies, robots, or similar methods to extract information from our platform for any external purpose.
3.13 You are prohibited from: advertising pyramid schemes; requiring payment from Enquirers simply to make an enquiry; using the platform to send unsolicited commercial messages or spam; or using database tools to contact users about properties or businesses unrelated to their enquiries.
3.14 You must not issue media statements or public communications that reference AllCommercial or AllMedia Group without our prior written consent.
4.1 Plan Types
AllCommercial offers two sets of Subscription Plans, each available at three tiers (Starter, Growth, and Premium):
Current plan pricing, inclusions, and boost allocations are published on our Advertise page at AllCommercial.com.au/advertise. AllCommercial reserves the right to update pricing and plan inclusions at any time with reasonable notice to existing subscribers.
4.2 Plan Inclusions
All Subscription Plans include access to unlimited active listings and the platform’s core features, as detailed on the Advertise page. Each plan tier includes a monthly allocation of Ad Boost credits. Boost credits reset on the 1st of each calendar month and do not roll over. Unused credits are forfeited at month end.
4.3 Boost Products
The following boost types are available within Subscription Plans and as standalone add-on packs. Full pricing and pack options are published at AllCommercial.com.au/advertise.
Add-on boost packs are non-refundable and non-transferable. Credits expire as per the terms of the relevant boost type set out above.
5.1 All fees are quoted and billed in Australian Dollars (AUD), inclusive of GST, unless otherwise stated.
5.2 Subscription Plans are billed monthly in advance and automatically renewed each month unless written notice of cancellation is provided at least 14 days before the next renewal date.
5.3 Annual plans are billed upfront at a 15% discount on the equivalent monthly rate. Annual plans are non-refundable once the billing period has commenced.
5.4 Invoices for monthly subscriptions are due within 14 days of the invoice date. Failure to pay on time may result in suspension or deactivation of your account and removal of active listings.
5.5 Invoices for add-on boost pack purchases are due within 14 calendar days of the invoice date. If payment is not received within this period, services may be suspended and any active boosts may be deactivated until payment is received.
5.6 Ad boost pack credits are non-refundable, non-transferable, and subject to the expiry terms set out in clause 4.3.
5.7 AllCommercial reserves the right to modify pricing at any time with reasonable notice. The amount payable is the rate confirmed at the time of purchase.
5.8 If payment remains overdue for more than 10 days after the due date, AllCommercial may: suspend or deactivate your account and associated services; charge late fees or reasonable recovery costs; or refer the debt to third-party collection agencies or take legal action.
5.9 You agree that AllCommercial may obtain credit information about you from credit reporting agencies for the purpose of collecting overdue payments. AllCommercial may also disclose your information to a credit reporting agency as permitted by applicable Privacy Laws and Credit Laws.
5.10 All amounts invoiced are subject to GST and any other applicable indirect taxes. If tax rates change, invoiced amounts may be adjusted accordingly.
6.1 All listings published on AllCommercial.com.au must comply with all relevant Australian laws, including those governing commercial property advertising, business opportunity advertising, consumer rights, anti-discrimination, and data protection.
6.2 Only genuine commercial properties and business opportunities may be advertised. At the time of posting, the property or business must be actively available for sale or lease. AllCommercial may request documentation to verify the legitimacy of a listing at any time. Failure to provide supporting documentation within a reasonable timeframe may result in suspension or removal of the listing.
6.3 Listings that include claims related to rental income, business earnings, profit, or financial performance must be supportable with credible evidence. If such evidence is not provided within three (3) business days of a request, AllCommercial may remove or suspend the listing without notice.
6.4 Listings must be placed in the appropriate property category. AllCommercial’s eight property categories are: Shop & Retail; Factory, Warehouse & Industrial; Medical/Consulting; Offices; Development/Land; Showrooms/Bulky Goods; Rural/Farming; and Hotel/Motel/Pub & Leisure. Misplaced listings may be reclassified or removed by AllCommercial.
6.5 External website links or third-party application forms must not be included in advertisements unless express written permission is granted by AllCommercial. This approval may be withheld or withdrawn at any time.
6.6 Properties or businesses located outside of Australia may not be listed on the platform without prior written consent from AllCommercial.
6.7 Standard listings remain active for the duration of the Subscription Plan. Listings will be deactivated if the Subscription Plan lapses or is cancelled.
6.8 AllCommercial reserves the right to edit, reclassify, or remove any listing that does not comply with these Terms, applicable law, or our content standards, with or without notice.
6.9 It is the Advertiser’s responsibility to keep listing details accurate and up to date. AllCommercial accepts no liability for errors, omissions, or outdated information in listings.
7.1 Boost credits included in a Subscription Plan reset on the 1st of each calendar month. Unused credits do not roll over and are forfeited at the end of each month.
7.2 Featured and Premium Boost credits (both plan-included and add-on pack) expire 30 days from the date of activation. Expired credits are forfeited and non-refundable.
7.3 Sponsored Ad credits activate on the date selected by the Advertiser and run for the chosen duration (14 or 21 days). Once activated, Sponsored Ads cannot be paused, transferred, or refunded.
7.4 AllCommercial does not guarantee specific placement positions or enquiry volumes as a result of any Boost or Sponsored Ad. Placement is determined by the boost tier in effect at the time of a search query.
7.5 Boost products are non-transferable between accounts or listings.
7.6 AllCommercial reserves the right to modify the structure, pricing, or availability of Boost products at any time with reasonable notice.
8.1 We may issue you one or more secure login accounts to access our Services. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account.
8.2 You are liable for any use of our Services made through your account unless misuse is the direct result of our negligence.
8.3 You must notify us immediately if you become aware of any unauthorised access to or use of your account.
8.4 AllCommercial may suspend or terminate your account at any time if we reasonably believe you have breached these Terms, pose a security risk, or are acting in a manner that could harm other users or our reputation.
8.5 On cancellation or termination of your account, all active listings will be deactivated and any unused boost credits will be forfeited. No refund will be provided for any unused portion of a monthly subscription or prepaid add-on packs.
9.1 We may decline your account registration if we reasonably believe you may not comply with these Terms, pose a security risk, or may act in a manner that negatively impacts our platform or reputation.
9.2 We reserve the right to remove listings, suspend, or terminate accounts where we reasonably determine that an Advertiser presents a security threat, is likely to harm our reputation, or is misusing our platform. No refund or compensation will be provided in these circumstances.
9.3 If we reasonably suspect misuse of our platform, we will contact you and raise the concern. Should misuse continue, we may take any measures we deem reasonably necessary, including removing listings, withdrawing discounts, or terminating your account.
9.4 In cases of deliberate and knowing misuse, we may take immediate corrective action without prior notice. No compensation or refund will be provided.
9.5 We are committed to maintaining a respectful working environment. Abusive, harassing, discriminatory, or bullying behaviour directed at our team will result in denial of service, suspension, or immediate account termination with no refund.
9.6 If you wish to dispute any action taken under this section, contact us and we will review your concerns promptly and in good faith.
10.1 All content on AllCommercial.com.au, including but not limited to text, graphics, logos, software, and platform functionality, is owned by or licensed to AllMedia Group Pty Ltd and is protected by Australian intellectual property laws.
10.2 By publishing a listing on AllCommercial.com.au, you grant AllCommercial a non-exclusive, royalty-free licence to display, reproduce, and distribute your listing content on the platform and through associated marketing channels for the purpose of promoting your listing.
10.3 You retain ownership of all content you submit. You warrant that you have the right to grant the above licence and that your content does not infringe any third-party intellectual property rights.
10.4 AllCommercial’s trademarks, brand names, and logos may not be used without prior written consent.
11.1 AllCommercial collects, uses, and stores personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and our Privacy Policy, available at AllCommercial.com.au/privacy.
11.2 Advertiser Data remains your property. AllCommercial will not sell your data to third parties. We may use Ancillary Data (aggregated, de-identified usage insights) to improve the platform and our services.
11.3 Enquirer contact details submitted through the platform are to be used solely for the purpose of responding to property or business enquiries. You must not use Enquirer data for unsolicited marketing, spam, or any purpose unrelated to the specific enquiry.
11.4 AllCommercial may disclose your information to a credit reporting agency or other relevant parties as permitted by applicable Privacy Laws and Credit Laws where necessary for the collection of overdue payments.
12.1 To the maximum extent permitted by law, AllCommercial is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or Services, including loss of revenue, loss of data, or loss of business opportunity.
12.2 AllCommercial does not warrant that the platform will be available at all times, error-free, or free from interruption. We will use reasonable endeavours to minimise downtime and notify users of planned maintenance.
12.3 AllCommercial does not guarantee that any listing will generate enquiries, leads, or a sale or lease outcome. Results depend on market conditions, listing quality, and other factors outside our control.
12.4 Where our liability cannot be excluded under the Australian Consumer Law, our total liability to you is limited to the amount paid by you for the Services in the three (3) months preceding the event giving rise to the claim.
12.5 Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.
13.1 From time to time, AllCommercial may offer promotional pricing, trial periods, or discounts. These offers are non-transferable unless clearly stated otherwise.
13.2 Promotional offers may be withdrawn at any time without notice and are subject to availability.
13.3 Misuse or unauthorised transfer of a promotional offer will be deemed a breach of these Terms.
13.4 Annual plan discounts are applied at time of purchase and are non-refundable once the billing period has commenced.
14.1 Monthly Subscription Plans may be cancelled at any time by providing written notice at least 14 days before the next renewal date. Cancellation takes effect at the end of the current billing period.
14.2 No refund will be provided for any unused portion of the current monthly billing period upon cancellation.
14.3 Annual plans are non-refundable once the billing period has commenced. You may cancel an annual plan but will not receive a pro-rata refund for the remaining months.
14.4 On cancellation or termination, all active listings will be deactivated and all unused boost credits will be forfeited immediately.
14.5 AllCommercial reserves the right to terminate your account immediately and without refund where you have breached these Terms, engaged in fraudulent conduct, or acted in a manner that poses a risk to our platform, users, or reputation.
15.1 AllCommercial reserves the right to update or amend these Terms at any time. We will provide reasonable notice of material changes via email or a notice on the platform.
15.2 Your continued use of the platform after changes take effect constitutes your acceptance of the updated Terms.
15.3 If you do not agree to any updated Terms, you must stop using the platform and cancel your Subscription Plan in accordance with clause 14.
16.1 These Terms are governed by the laws of Victoria, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
16.2 AllMedia Group Pty Ltd is committed to resolving disputes fairly and in good faith. We encourage you to contact us in the first instance to attempt to resolve any concern before initiating formal proceedings.
